The production calendar for 2016 provides the standard working hours for months, quarters and the year as a whole for 40-hour, 36-hour and 24-hour work weeks. The number of working days and days off is also indicated for a five-day work week with two days off.

Holidays

According to Article 112 of the Labor Code of the Russian Federation, the following non-working holidays are established in the Russian Federation:

  • January 1, 2, 3, 4, 5, 6 and 8 – New Year holidays;
  • January 7 – Christmas;
  • February 23 – Defender of the Fatherland Day;
  • March 8 – International Women's Day;
  • May 1 – Spring and Labor Day;
  • May 9 – Victory Day;
  • June 12 – Russia Day;
  • November 4 is National Unity Day.

Article 6 of the Labor Code of the Russian Federation, laws and other regulatory legal acts of state authorities of the constituent entities of the Russian Federation may establish additional non-working holidays. This norm is also contained in the Resolution of the Presidium of the Supreme Court of the Russian Federation dated December 21, 2011 No. 20-ПВ11 and in paragraph 8 of the letter of the Ministry of Labor of the Russian Federation dated July 10, 2003 No. 1139-21.

Religious holidays may be declared additional non-working holidays in the manner prescribed by Part 7 of Art. 4 of the Federal Law of September 26, 1997 No. 125-FZ.

Transfers of non-working days

According to part five of Article 112 of the Labor Code of the Russian Federation, for the purpose of rational use by employees of weekends and non-working holidays, weekends may be transferred to other days by federal law or a regulatory legal act of the Government of the Russian Federation

By Decree of the Government of the Russian Federation dated September 24, 2015 No. 1017 "" the following days off were postponed:

  • from Saturday January 2 to Tuesday May 3;
  • from Sunday January 3 to Monday March 7;
  • from Saturday 20 February to Monday 22 February.

Thus, taking into account the postponement of holidays in 2016, the “New Year holidays” for employees will last 10 days – from January 1 to January 10, 2016.

In May 2016, non-working days will be the days from May 1 to May 3 - the Spring and Labor Festival, as well as from May 7 to 9 - the Victory Day holiday. In June, the rest period in connection with the celebration of Russia Day will last from June 11 to 13, and in November, the National Unity Day holiday will last from November 4 to 6, 2016.

Standard working hours

In accordance with the procedure approved by Order of the Ministry of Health and Social Development of Russia dated August 13, 2009 No. 588n, it is calculated depending on the established duration of working hours per week according to the calculated schedule of a five-day work week with two days off on Saturday and Sunday, based on the duration of daily work (shift). Thus, with a 40-hour working week, the standard working time will be 8 hours; with a working week of 36 hours, it is equal to 7.2 hours; with a 24-hour work week it will be 4.8 hours.

In accordance with Part 1 of Article 95 of the Labor Code of the Russian Federation, the duration of the working day or shift immediately preceding a non-working holiday is reduced by one hour. In 2016, employees will work one hour less on February 20 and November 3.

The standard working time calculated in the specified order applies to all work and rest regimes.

Public holidays in 2016

According to Art. 112 of the Labor Code of the Russian Federation, non-working holidays in Russia are the following dates:

  • January 1, 2, 3, 4, 5, 6 and 8 - New Year holidays
  • January 7 - Christmas
  • February 23 - Defender of the Fatherland Day
  • March 8 - International Women's Day
  • May 1 - Spring and Labor Day
  • May 9 - Victory Day
  • June 12 - Russia Day
  • November 4 - National Unity Day

If a public holiday falls on a Saturday or Sunday, the day off is transferred to the next working day. In 2016, Spring and Labor Day (May 1) and Russia Day (June 12) fall on Sundays, so the weekend moves to Mondays May 2 and June 13, respectively.

The Government of the Russian Federation has the right to make changes to the production calendar, shift non-working holidays to other dates in order to rationalize the labor process (Article 112 of the Labor Code of the Russian Federation). For 2016, the following holiday transfers have been approved:

  • from Sunday January 3 to Monday March 7;

On the eve of official state holidays, working hours are reduced by 1 hour, the same for both a 40-, 36- and 24-hour five-day working week (Part 1 of Article 95 of the Labor Code of the Russian Federation). If a holiday falls on a Sunday, then the work hours on Friday are not reduced. In 2016, there are 2 pre-holiday days in Russia: February 20, November 3.

Changes in the calendar in 2016 in the Russian Federation

Standard working hours- this is a certain number of hours that an employee works in accordance with the labor or collective agreement during a certain calendar period.

Standard working hours. Work on days off

If an employee works beyond the monthly working hours, work on a day off must be paid at least twice the salary. Or in a single amount above the salary, if the employee works on a day off within the monthly norm (Article 153 of the Tax Code of the Russian Federation). The code also states that an employee does not have to pay for a day of rest that is provided for working on a day off. At the same time, the day of rest is excluded from the standard working hours for the month. If other days are worked, then the employee must be paid the full salary for the month. This is what officials think (letters from Rostrud dated 02/18/13 No. PG/992-6-1, Ministry of Labor of Russia dated 03/11/13 No. 14-2/3019144-1157).

The amounts that the employer accrues in accordance with the legislation are taken into account in labor costs (Article 255 of the Tax Code of the Russian Federation). This means that the company has the right to take into account in its income tax expenses the full salary and the daily rate for work on days off in addition to the salary. Officials also adhere to the same position (letter of the Ministry of Finance of Russia dated July 14, 2015 No. 03-03-06/40358).

Working beyond normal working hours

The irregular regime does not depend on the type of activity of the company (Article 101 of the Labor Code of the Russian Federation). The list of positions with irregular hours must be determined in the collective agreement or order of the manager.

For example, employees providing consulting and legal services may work beyond normal working hours. Customers often ask questions after six o'clock in the evening, so companies give some employees irregular working hours.

It is possible to establish irregular working hours for all employees, but it is unlikely to be justified. After all, this is a special regime in which individual employees can be occasionally involved in work outside the assigned time. If you set an irregular day for everyone, then during an inspection this may be regarded as a hidden form of overtime.

The Code does not directly prohibit the establishment of irregular hours for all employees. From Article 101 of the Labor Code of the Russian Federation it only follows that it is impossible to constantly attract all specialists during non-working hours. This means that you can set an irregular schedule for everyone, but involve employees in this mode one by one.
