Agreement on the provision of training services (public offer)
1. GENERAL PROVISIONS
1.1. By accessing this website - site - (hereinafter referred to as the Contractor), the user (hereinafter referred to as the Customer) confirms his consent to use the website in accordance with the terms of use specified in this agreement.
1.2. In accordance with Article 633 of the Civil Code of Ukraine, this agreement is public offer(public contract), and if its conditions (acceptance) are accepted, the Customer undertakes to fulfill them in good faith.
1.3. The Customer's disagreement with the conditions specified in this Agreement entails the impossibility of providing the Contractor with services (online training).
1.4. The Customer grants permission to the Contractor to process his personal data in accordance with the Law of Ukraine "On the Protection of Personal Data".
2. SUBJECT OF THE CONTRACT
2.1. The Contractor, in accordance with the terms of this Agreement, provides the Customer with training services, according to the curricula, a detailed description of which is contained on the website (hereinafter - online training services).
2.2. The fact that the Customer pays for training services indicates the Customer's unconditional acceptance of the conditions specified in this Agreement.
2.3. The cost of training services is determined depending on the curriculum chosen by the Customer.
2.4. The Contractor reserves the right to change the cost of curricula at its discretion with prior notification on the website.
3. RIGHTS AND OBLIGATIONS OF THE CONTRACTOR
3.1. The Contractor undertakes:
3.1.1. On the basis of this Agreement and after paying the cost of the curriculum chosen by the Customer, provide him with services on time and for the period determined by the specified curriculum.
3.1.2. Before starting the provision of services, provide access to instructions (text / video), which explains how to complete training according to each of the selected curricula.
3.1.3. Ensure continuity educational process in accordance with the curriculum chosen by the Customer.
3.1.4. Provide access to teaching materials(video lessons) within 24 hours from the moment of payment for the selected curriculum.
3.1.5. Eliminate technical issues that prevent viewing of training materials within three working days.
3.1.6. Timely notify the Customer about the appearance of additional lessons in the selected (already purchased) curriculum.
3.1.7. Provide the Customer with services in accordance with the terms of this Agreement.
3.2. The contractor has the right:
3.2.1. Suspend / terminate the provision of training services to the Customer (until the circumstances are clarified or permanently) unilaterally in the following cases:
- The customer has violated the terms of this Agreement;
- In case of committing illegal or questionable actions in the Customer's account;
- In case of unauthorized attempts to transfer / distribute the course materials to third parties;
3.2.2. Unilaterally terminate this Agreement ahead of schedule if the Customer fails to comply with its terms.
3.2.3. To unilaterally make changes to this Agreement, as well as curricula and the cost of training services with their preliminary publication on the website.
3.2.5 Replace video tutorials when errors or technical malfunctions are found.
4. RIGHTS AND OBLIGATIONS OF THE CUSTOMER
4.1. The customer is obliged:
4.1.1. Conscientiously fulfill the terms of this Agreement, observe the rules of conduct and pay for training services according to the chosen curriculum.
4.1.2. Before starting the provision of training services, be briefed on the training rules.
4.1.3. Do not transfer access to your account to third parties.
4.1.54 Not to publish, not to transfer to third parties and not to use for commercial purposes the teaching materials provided to the Customer in the course of providing him with training services, including for independent work.
4.2. The customer has the right:
4.2.1. Receive training services provided for in this Agreement.
4.2.2. Require the Contractor to comply with the terms of this Agreement.
4.2.3. Make payment to the Contractor for training services, according to the chosen curriculum, in any of the ways provided by the current legislation of Ukraine.
4.2.4. Terminate this Agreement unilaterally, subject to two days' prior notice to the Contractor. In case of early termination of this Agreement, the payment to the Customer for the training service is not refundable.
5. PAYMENT PROCEDURE
5.1. Training services under this Agreement are provided exclusively on the basis of 100% payment of their cost for a specific curriculum.
5.2. All settlements are carried out in the national currency of Ukraine - hryvnia.
5.3. The Contractor is not responsible for the procedure for transferring / crediting funds.
5.4. The moment of payment is the moment when funds are credited to the account of the Contractor or cash is received by the Contractor.
6. LIABILITY
6.1. For non-fulfillment or improper fulfillment of the terms of this Agreement, the Contractor and the Customer are liable under this Agreement and the current legislation of Ukraine.
6.2. The Customer realizes that his violation of the terms of this Agreement leads to its termination by the Contractor unilaterally with the subsequent termination / suspension of the provision of training services.
6.3. The Contractor assumes full responsibility in accordance with the requirements of the Law of Ukraine "On the Protection of Personal Data".
6.4. The Contractor is not responsible for unedited teaching materials that are transferred to the Customer when providing him with training services according to the selected curriculum, including for independent work.
6.5. The customer bears full responsibility for illegal access and unauthorized interference in the operation of computers, systems and computer networks in accordance with the current legislation of Ukraine.
6.6. In case of violation by the Customer of the terms of the Agreement, the Contractor is released from fulfilling the obligations assumed under this Agreement.
7. FORCE MAJEURE
7.1. The Contractor and the Customer are released from liability for full or partial failure to fulfill their obligations under this Agreement, if this was the result of force majeure circumstances that arose after the entry into force of this Agreement as a result of extraordinary events that could not be foreseen and which could not be prevented by reasonable measures ...
8. DURATION OF THE CONTRACT
8.1. The contract comes into force from the moment of payment for training services by the Customer to the Contractor and is valid for the entire period specified in the curriculum chosen by the Customer.
8.2. This Agreement may be terminated (terminated) with the consent of the Customer and the Contractor.
8.3. In the event that the Customer decides to terminate (terminate) this Agreement after the start of the provision of training services, while the Customer has made full payment for the training services, the Contractor does not return the funds to the Customer.
9. DISPUTE RESOLUTION
9.1. All disputes and disagreements arising from the fulfillment of the terms of this Agreement shall be resolved through negotiations on the basis of a written application (claim) of the Customer, with the addition of a check (receipt) for payment for training services.
9.2. The Contractor, after receiving an application (claim) from the Customer, is obliged to satisfy the stated requirements or send a reasoned refusal to the Customer within 20 (twenty) days.
9.3. If the dispute that has arisen is not settled in a claim procedure, the Customer or the Contractor has the right to go to court at the location of the Contractor.
9.4. The customer of the services guarantees that all the terms of this Agreement are clear to him, and he accepts them unconditionally and in full.
